Work Permit
An open work permit allows a Canadian immigrant to work openly throughout the country. This allows you to work at any location and for any employer so long as they are credible businesses. When hiring an immigrant, Canadian firms will likely be required to submit a Labor Market Impact Assessment (LMIA) to ensure they have adequately searched for a Canadian national to fill their vacant job position.
You are eligible for an open work permit if you meet on the following criteria:
- If you are a permanent resident
- If you have dependent family that are permanent residents
- If you have a spouse or common-law partner who are Canadian citizens or permanent residents, or if they are students who have an active study permit
- If you are a refugee or protected person or a family member of a refugee or protected person
- If you are a young worker who is specializing in a special worth work program
Employer Specific Work Permit
An employer specific work permit allows foreign workers to work for a specific employer at a specific location. This type of work permit will feature you name, the employer you are going to work for, the duration of your employment and the location of your office place. This permit is also known as a closed-work permit and if often subject to a job offer by a Canadian employer who has completed a LMIA report proving that there is no Canadian citizen or permanent resident who is qualified to take this job.
Eligibility: To determine if you are eligible to apply for a work permit, certain conditions need to be met:
- Applicants must be able to prove they will leave the country after their permit ends
- Applicants must not work for employers who have failed to comply with the employment decency standards
- Some examples of employers that do not comply with these standards are strip club dancers, escorts, or similar professionals
- Applicants must pass a medical exam
- Applicants must have enough funds to support themselves and their family members for their entire stay in Canada
Applying from Outside Canada
Depending on your country of origin you may be able to apply for a work permit through a visa office outside of Canada. These offices will be able to guide you through the required documentation, fee and procedures associated with your application. You will likely also need to successfully complete a police clearance exam and well as a medical examination from a designated medical doctor.
Apply from Inside Canada
You are eligible to apply for a work permit while you are inside Canada if you meet the following criteria:
- You or your spouse are currently living in Canada and have a valid study permit or work permit
- You have graduated from an accredited educational institute within Canada, or if you are eligible for a Post-Graduate Work Permit
- You have applied for a permanent resident permit and are waiting for a decision from a Canadian immigration official
- You have asked for refugee status and are waiting for approval from a Canadian immigration official
- A work permit can be grated when you land into Canada of you are from a visa-exempt country with a valid medical clearance
Super Visa
The standard length of time for a visitor permit is 6 months. After that period of time visitors will need to apply for a new immigration permit and pay the associated fees. However, parents of grandparents of children or grandchildren currently living in Canada can apply for a super permit that allows them to apply for a single one-time permit that is valid for 10-years.
There are a few conditions that must be met before you are able to apply for a super permit. These conditions are as follows:
- Applicants must be allowed to enter Canada
- Applicants must have a child or grandchild that is a Canadian national
- Applicants must obtain a signed letter from your Canadian relative inviting you to Canada. This letter must contain evidence that they have sufficient funds to care for you during you state in Canada. The letter must also confirm the number of residents living in your accommodations as well as your relative’s Canadian citizenship
- While in Canada, applicants are not allowed to seek employment
- Applicants must complete a medical exam
- Applicants must provide evidence that they will leave Canada at the end of their super visa
Visitor Visa
Traditionally, foreign travelers must obtain a Temporary Resident Visa (TRV) or an Electronic Travel Authorization (ETA). Visitor visas are not immigration-based visas, and strictly for people interested in traveling to Canada on a short-term basis. American citizens or people with pre-existing Canadian visas are able to travel to Canada without the need for a traveler’s visa. Those who are not American citizen’s or currently in possession of a Canadian visa will likely need to apply for an Electronic Travel Authorization (ETA) before entering Canada – often before boarding their airplane or means of transportation into Canada.
It’s important to note that you are not required to obtain both an ETA and TRV. An ETA is only required for visa-exempt travelers. Nationals from countries that are not currently visa-exempt must apply and be accepted for a TRV. TRV’s are issued outside of Canada by representatives of Canada’s immigration office.
Visa-exempt travelers trying to obtain an ETA must pay a processing fee of 7 CAD in order for the ETA to be issued. ETA’s are valid for five years from the day of issue.
International Experience Canada
International Experience Canada is a program designed for youth between the ages of 18-35 to travel and work inside Canada. There are three categories for this program:
- Working Holiday Program
- Young Professional Program
- International Co-op Internship
Working Holiday Program
The working holiday program allows visitors to apply for an open work permit allowing you to fund your holiday through Canada. You must meet the following criteria in order to be accepted into this program:
- Applicants must not have a job offer.
- Applicants must be willing to work for more than a single employer.
- Applicants must be willing to work in more than one location.
Young Professional Program
This program was developed by the IEC to enable young professionals the ability to gain valuable work experience with a single employer. Applicants interested in this program will need to obtain an employer-specific work permit before traveling to Canada. Similar to the Working Holiday Program, the YPP has certain requirements:
- Applicants must have an offer for employment by a Canadian company.
- Applicants must be able to work for the same employer and stay in the same location.
- All jobs must be paid and not considered “self-employed”.
International Co-op Internship
For students interested in gaining on-the-job experience while inside Canada, the IEC developed the International Co-op Internship program. In order to partake in this program, applicants will need to secure an employer-specific work permit. Moreover, applicants must take an internship that specifically relates to their studies and must be recognized by the National Occupational Classification (NOC). What is more, the internship must meet the NOC skill types – level “O”, “A” or “B”. NOC Job type “C” may also qualify if your internship is directly connected to your field of study if you are attending a post-secondary institution in your home country. Like the previous two programs, there are specific requirements for the International Co-op Internship Program:
- Applicants must be students that are registered in a post-secondary institution.
- Applicants must have an internship offer from a Canadian company.
- Applicants must confirm that an internship is required to complete their studies.
- Applicants must work for the same company and stay in the same location for the duration of their internship.
If you are interested in partaking in any of the IEC programs, the first step is to enter the IEC applicant pool. This pool is a collection of similar applicants waiting for the invitation to apply for a work permit. Once you have been invited to apply for a work permit and have submitted your application a Canadian immigration officer will assess your credentials. During this assessment, you will be notified if you are required to provide additional paperwork, submit a police clearance report, or medical exam.
